AB 1892: What Changes for HOA Acclamation and E-Voting Notices in 2027

    ByPresident & Inspector of ElectionsOctober 19, 2026

President of HOA Elections of California, Inc., an Inspector of Elections firm serving California associations since 2006.

Quick answer: AB 1892 (Chapter 169, Statutes of 2026) takes effect January 1, 2027. For an election by acclamation, the initial notice drops from at least 90 days to at least 30 days before the nomination deadline, and the reminder notice must go out at least 10 days before the deadline. For electronic voting, the individual notice with voting instructions now goes only to members who are voting electronically, still no later than 30 days before the election. Notices sent in 2026 follow today's rules.

    The three changes

Initial acclamation notice (Civil Code §5103)

Through December 31, 2026: at least 90 days before the nomination deadline.

Starting January 1, 2027: at least 30 days before the nomination deadline.

Acclamation reminder notice (Civil Code §5103)

Through December 31, 2026: between 7 and 30 days before the nomination deadline.

Starting January 1, 2027: not less than 10 days before the nomination deadline.

Electronic voting notice (Civil Code §5105)

Through December 31, 2026: individual notice of the electronic secret ballot goes to members no later than 30 days before the election.

Starting January 1, 2027: the notice goes only to members who are voting electronically, no later than 30 days before the election. Sending it earlier is allowed.

    What stays the same

AB 1892 changes timing, not the conditions. To seat candidates by acclamation the association still needs a regular election within the last three years, both notices with the required contents, nomination acknowledgments and qualification decisions within seven business days, an open nomination process, and a board vote at a meeting whose agenda names each candidate. Acclamation is still optional.

    Planning tips

    • Thirty days is a floor. A longer window still gives more members time to run.
    • Mail time matters. If members can nominate by mail, send the reminder closer to 14 days out on a business day so a mailed nomination can come back before the deadline.
    • Do not apply the shorter timeline to a notice sent in 2026 just because the election is in 2027. If your process crosses January 1, 2027, confirm the rules with association counsel.
    • Keep your electronic voting opt-in list current, since only those members receive the voting instructions.
